Getting Social Security Long-Term Disability starts with the application process.  There are three simple ways to apply for Social Security Disability benefits, online, by phone, and in person.  Social Security’s toll free number 1-800-772-1213 allows you to apply for benefits on the phone or make an appointment with your local Social Security Office to apply in the office.

Applying Online

Applying for benefits online at www.ssa.gov has several advantages. Using the online application allows you to complete the application at your own pace. This is especially important if you need to gather information about your doctors, hospitalizations or other medical information. Your chances of a successful application are better if you can give as much information as possible about your condition.

Additional Information

After completing the initial application, Social Security may contact you to verify information, request releases of information for your doctors or to request additional information. Social Security will also help you get information to pursue your disability claim by sending you to doctors for additional evaluation if they do not have enough information to make a decision on your application. Social Security bears the cost of additional evaluations and if possible requests the evaluations from doctors that you see regularly.

Determination

Once the application is completed, your claim is sent to the Disability Determination Services office for your state. This agency makes the decision on your claim using Social Security laws and regulations. Any decisions made by this agency can be appealed. Requests for additional information from this agency should be sent directly the claims specialist handling your claim instead of your local social security office to prevent delays in the application process. It can take three to five months to get an initial decision on your claim.  You should file an application for benefits as soon as you believe you are disabled.

If an Application is Denied

Be aware that it is not unusual for the initial application to be denied, but you do have appeal rights. If your initial application is denied, you have the right to request reconsideration and provide and additional information on your case. The next level of appeal from the reconsideration is the request for a hearing with an administrative law judge.

When to Consult a Disability Attorney

You have the right to legal representation at any stage of this process. Social Security will withhold up to twenty-five percent of any pass due benefits to pay for attorney’s fees. Experience legal counsel can improve the likelihood of a successful claim for benefits.
