There is generally no situation where a denial of disability insurance benefits to an applicant in a Social Security administration program is illegal. That said, I think everyone recognizes that there is no State or federal government facility on the planet that does not have some level of internal corruption. Corruption produces situation where Social Security administration workers acting on an internal basis take some type of fraudulent action to facilitate the approval of some applications for benefits, speed up the approval of other applications and assure the denial of other applications. These situations can even involve temporary worker allowed to access applicants and other internal information such as computer databases. Access to large database with internal access rights can give an employee unlimited ability to alter the claims of countless people without detection. If these people are ever caught they would likely be fired but it would be extremely difficult to impossible to collar employees committing this type of white collar crime.
There are countless methods by which internal employees can illegally impair or improve an applicant’s chances for being approved for benefits.
This sort of employee mischief does happen every day in countless Social Security offices. It is next to impossible for an applicant to take any steps to prove this kind of harassment. “Who ya gonna call? Ghost busters?” Most employees are not willing to report fellow workers especially if those workers have their own “gang” or underground kickback network. The computer will retain evidence of the truth in many cases but no internal employee is ever going to both to try to bring it into light for a so called “disgruntled applicant.”
If you or a member of your family has received unfair or unethical treatment of your application for benefits which you believe may be the result of internal fraud or intentional employee mishandling of your claim it is extremely important that you contact a disability lawyer to discuss circumstances of mishandling or fraud concerning your application resulting in an illegal denial of disability insurance benefits.
