New Jersey Private Disability Benifits Appeal - Private Plan


If you disagree with a determination made by a private plan carrier, you have the right to appeal to the Division of Temporary Disability Insurance. You have one year from the date your disability began to file your appeal.

When an appeal is filed, you will be notified by mail of the date, time and location of the appeals hearing. Hearings may be held at various locations throughout the State. The hearing may also be held by telephone. Your appearance before the Private Plan Hearing Officer will not cost you anything. It is not necessary to have legal representation. However, you may have an attorney represent you, if you choose.


Following the hearing, the Private Plan Hearing Officer will issue a written order which is binding. However, if you disagree with that decision, you have the right to file an appeal with the Appellate Division of the New Jersey Superior Court. The appeal to the court must be filed within 45 days of the date of mailing on the Private Plan Hearing Officer's order.
