Depression is one of the conditions listed under Mental Disorders in the Listing of Impairments under Social Security Disability regulations. It is considered an affective disorder. It must me the severity test required of all disorders in that the condition must be expected to last a year and be so severe as to significantly limit the ability to do basic work activities—such as walking, sitting, and remembering. A condition that meets the listing of impairments means that a person will be considered disabled by operation of law, without the need for further proof. If a condition does not meet the listing of impairments the disability determination service will look at other factors to determine disability such as can you do the work you did before? Can you do any other type of work? The agency evaluates your medical condition, your age, education, past work experience and any skills you may have that could be used to do other work. A finding that you cannot do either of these will result in a favorable decision.
You should consider contacting an attorney who specializes in disability law and has experience in handling Social Security cases. He or she could give you more information about how Social Security decides the medical portion of your Social Security Disability claim. Mental conditions can be the most difficult cases to prove so legal representation is important.
