Question:

How will the benefits for my physical disability be calculated?

Answer:

When you suffer a physical disability, the benefits that you may be able to receive for that disability are going to depend heavily on exactly what kind of benefits you are seeking and how the disability happened:

  • Those who are adults who have worked for a set minimum amount of hours (based on age) will be able to apply for social security disability insurance (SSDI) if their physical disability is sufficiently serious and long term. Whether or not the physical disability is serious enough to make you eligible for benefits is going to depend on whether you are rendered unable to work as a result of it, whether it is listed in the blue book listing of impairments, and whether it is sufficiently impairing of your daily activities. Assuming you qualify for such benefits, the amount you receive will be based on the length of time you have worked, your age and the amount of money that you have earned and paid into the social security system.
  • Those who are injured at work will be eligible for workers compensation disability benefits. The rules for exactly how such benefits are determine vary by state, but in general, the amount of benefits here is based on your impairment rating or the level of disability in many states, as well as on your wages.

If you need help determining exactly how much your benefits will be based on your specific disability and past income earned, it is in your best interests to consult with an experienced disability rights attorney in your local area.
