How do I file a disability claim for my neurological disorder?

A neurological disability may be any of a number of conditions where there is substantial damage to the person’s central nervous system. Generally, the problem occurs in the brain or in the spinal cord. When it occurs, such as through an accident, the person may be left with severe impairments, both mentally and physically. If this happens, you may be able to obtain benefits from the Social Security Administration as a result.

Filing a Claim

If you suffer from a neurological disorder, either from an injury or even from a degenerative condition, the first step to filing a disability claim is to consider the Listing of Impairments. This is a list of disorders the SSA recognizes as severely limiting and approves for disability. The symptoms of your condition must meet the minimum requirements under the Listing of Impairments. You will then need to consider the following:

  • You will need to file an application for disability through the Social Security Administration.
  • You will need to provide proof in the form of medical documentation to support your claim. These documents must be recent; having had an exam within the last six months is recommended.
  • The SSA will determine if you qualify or if additional information is necessary. If so, a hearing may occur in which you can further explain your circumstances.

Even if you do not qualify for disability under the initial Listing of Impairments, you may otherwise qualify if your condition leaves you unable to work. Discuss your case with a disability attorney.
