Question:

How do I establish that I have a permanent disability with the SSA?

Answer:

The SSA, or social security administration, pays benefits only for those who have a disability that is either long term or that is expected to be terminal. As such, if you wish to qualify for social security disability insurance (SSDI) benefits, you must be able to prove your disability meets these requirements for longevity. If you wish to prove that you have a permanent disability, there are a few things you need to do:

  • Determine if your disability is listed in the SSA blue book listing of impairments. If it is a listed disability, then you will need to read the criteria associated with that disability in order to determine if you meet all the specific requirements. If so, just submit proof that you do in the form of medical records and a physician's statement
  • If your disability is not a listed disability, you are going to need to prove that the condition you have is medically equivalent. This means showing that the condition impairs you just as much as those that are listed. Again, detailed medical records and statements from a doctor are going to be key here in making sure your claim is approved.

Many disability claims are initially denied, so you may have to go through several steps in order to qualify for benefits and prove your claim to the SSA. In order to have the best chance of making a successful claim for benefits, you should strongly consider getting help from an experienced attorney who specializes in social security disability claims.
