Question:

How do I establish disability for my severe headaches?

Answer:

Headaches, in general, are not listed as a disability according to Social Security. Severe headaches, however, can be just as disabling as grand mal seizures since an individual can be unemployable due to such (remember that what disability means in essence is that the disabled individual is unable to be gainfully employed). Though grand mal seizures, if not caused by epilepsy, rarely happen to an individual more than once in a lifetime, there are some people who have them once a month or more, which would result to the sufferers being unemployable.

Yes, severe headaches and/or migraines are considered by Social Security as a disability if diagnosed by a neurologist, especially if the individual rigorously follows the treatment plan prescribed by the doctor but still continues to suffer from the disorder. Establishing disability due to headaches is hard to prove, though. So to help establish headaches disability, one must therefore have himself checked by doctors and be able to pinpoint what type of headaches he suffers from – migraine, tension, hypertensive, etc. It would be good if he keeps records of headache episodes through the use of journals or calendars in order to establish the frequency and duration of each attack. Better still to have a CT scan if only to rule out possible causes of headaches like brain tumors and others. Finally, even if the type of headache an individual suffers from is truly disabling, he may still be denied the benefits he is entitled to, and this is where a good disability lawyer will be able to help.
