Question:

I have been dealing with COPD for a long time now and a friend suggested I apply for SSDI. Can I get disability benefits for having COPD?

Answer:

Chronic Obstructive Pulmonary Disease (COPD) is a disease that causes permanent and progressive obstruction of the lung airways, making it difficult for the person to breathe due to a lung disorder. It is also referred as chronic obstructive airway disease (COAD). If you are suffering from COPD, consult with an experienced disability lawyer. You may be entitled to social security disability benefits.

You can claim social security disability benefit if you are unable to work and you have earned a substantial gainful income performing past work or other work. Past work refers to jobs performed in the past 15 years, while other work refers to jobs you may be qualified to do because of your skills. The Social Security Administration will review your work history and medical records to determine if you can engage in past work or other work. If you are unable to do past work or other work, your application will be approved.

Your medical records and documents will play a vital role in the determination of your eligibility for benefits. An experienced disability lawyer can assist you with your application. If your application is approved, you will receive your first payment six months after your disability began. The amount of benefit that you will receive will depend on your lifetime average earnings covered by social security. You will continue to receive the benefits for the duration of your disability. Subsequently, if your health improves and you are able to get back to work, the benefits will stop.
