Question:

I am a federal employee; I have worked for the federal government for 10 years.  I was recently diagnosed with Multiple Sclerosis.  I have been advised to stop working, can I get disability retirement benefits.

Answer:

Disability retirement benefits are available employees working in the federal government as part of their benefit package.  Your condition must be expected to last at least a year; you must have worked in the Federal Civil Service for at least 18 months.  The agency that you work for would have to certify that they are unable to accommodate you disabling condition in your current position that it has considered you for any vacant position in the same agency at the same grade or pay level, within the same commuting area, for which you are qualified for reassignment.  They also require that you apply for Social Security Disability benefits. If you dismiss your Social Security Disability Insurance application for any reason, your application for disability retirement benefits will be dismissed.  There is also a time limit for filing.

You should consider consulting an attorney experienced in disability law.  This person should be able to help you with the federal system and your application for Social Security Disability benefits.
