Unsuccessful Work Attempt

Unsuccessful work attempt is another term utilized by social security. It is applicable for Supplemental Security Income and for Social Security Disability Insurance. An unsuccessful work attempt or UWA describes a specific type of employment encounter and its negative result. An individual is perceived to have had an UWA when he or she is forced to stop or reduce employment after a maximum of 6 months. The money gained falls below the Substantial Gainful Activity (SGA) after a short period as the result of factors relating to the impairment. The factors making it a UWA after from 3 to 6 months include frequent absences and unsatisfactory performances because of the disability. UWA is acceptable by Social Security if the work ceased because the employment was performed during a remission period or under special conditions. Another possible accepted reasons for a UWA are the elimination of special services or assistance required by the individual to perform the work. A UWA is not a given without documented evidence of a break in work continuity. This can be revealed by a discontinued, reduced or limited work performance. If, however, any indications of problems manifest themselves after 6-months, this may not be considered a UWA. It depends upon the earnings relation to the SGA. Talk to a lawyer for further explanation.
